2.2 Access and Availability: We strive to keep the Service available continuously; however, we do not guarantee that it will be error-free, uninterrupted, or available at all times. We reserve the right to modify, suspend, or discontinue, in whole or in part, the Service at any time without notice.

III. USER ACCOUNTS AND REGISTRATION

3.1 Account Creation: To access certain features of the Service, you may be required to create an account by providing accurate, current, and complete information. VI. AI COPILOT DISCLAIMER

AI Copilot is an AI-powered assistant offered as part of the ViaRad.io platform. It is designed to provide general guidance, creative suggestions, and content-related support to help users grow and manage their radio stations.

AI Copilot is not a substitute for technical support, legal advice, or professional consultancy, and should not be relied upon for critical or sensitive business decisions.

While we strive to ensure the assistant provides helpful and accurate information, ViaRad.io is not responsible for any errors, omissions, or outcomes resulting from the use of AI Copilot. All decisions made based on interactions with the assistant are the sole responsibility of the user.

By using AI Copilot, you agree to use the tool for informational and creative support purposes only, and you acknowledge that any content or recommendations generated by the assistant do not represent official advice from ViaRad.io.

VII. PAYMENT AND BILLING POLICY

6.1 Issuance of Payment Receipts and Invoices:

Individual Users (B2C): For individual users subscribing to our Services, ViaRad.io will issue a payment receipt confirming the completed transaction. This receipt serves as proof of payment and details the service provided.

Businesses and Commercial Clients (B2B): For business clients, a formal invoice will be issued detailing the provided services, including a description, amount, issuance date, and due date for payment.

6.2 Tax Exemption: In both cases (individual users and business clients), no additional taxes (such as Sales Tax or VAT) will be applied to transactions, as our digital services are tax-exempt under Wyoming law.

Example for Business Invoice: "This invoice is issued for digital services and is tax-exempt under Wyoming regulations. No sales tax has been applied."

Example for Individual Payment Receipt: "This payment receipt confirms the payment for digital services provided, which are tax-exempt under Wyoming regulations."

6.3 Payment Methods: Payments will be processed through the payment platforms enabled by ViaRad.io (e.g., Stripe, PayPal, or other providers). You agree to provide valid payment information and to update it as necessary.

6.4 Refunds and Cancellations:

ViaRad.io does not offer total refunds once the service has begun.

Customers are provided with a free trial period sufficient to evaluate our services. However, you may request a refund if the service has been impacted by us (not due to any causes beyond our control). In this case, compensation will be issued corresponding to a proportional portion of the service cost for the days the service was impacted.

You have the right to cancel a service at any time. To do so, simply cancel your subscription from your customer account. Please note that canceling a service does not entitle you to a refund of the amount paid once the service has begun, as described in the previous paragraph.

VIII. DISCLAIMERS AND WARRANTIES

7.1 "As Is" Service: The Service is provided "as is" and "as available." ViaRad.io does not guarantee that the Service will be free of errors or that its operation will be uninterrupted.

7.2 Disclaimer of Warranties: To the maximum extent permitted by law, ViaRad.io disclaims all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.3 Limitation of Liability: Under no circumstances shall ViaRad.io be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use or inability to use the Service, even if advised of the possibility of such damages.

IX. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ViaRad.io, its officers, employees, affiliates, agents, and licensors from any claim, loss, liability, damage, or expense (including reasonable attorney fees) arising out of your use of the Service, your breach of these Terms, or any violation of any rights of a third party.

9.1 Termination by the User: You may terminate your use of the Service at any time by notifying ViaRad.io through the means provided on our website.

9.2 Termination by ViaRad.io: ViaRad.io reserves the right to suspend or terminate your access to the Service at its sole discretion, without notice, for any reason, including if you violate these Terms.

9.3 Excessive resource usage: At ViaRad.io, we are always committed to providing high-quality service tailored to your needs. However, we reserve the right to cancel or suspend a service in exceptional cases, such as when resource usage significantly exceeds the established limits or impacts the experience of other customers. In such situations, we will reach out to you to find an appropriate solution and work together on alternatives that better suit your needs. Our goal is always to ensure the best possible experience for you and all our users.

XI. GOVERNING LAW AND DISPUTE RESOLUTION

10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the state of Wyoming, USA, without regard to its conflict of law principles.

10.2 Dispute Resolution: Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

XII. MISCELLANEOUS

11.1 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
